Burmester & Vogel Ltd., a Delaware corporation (“B&V”, “We”, “Our”) is committed to safeguarding your privacy online. This Privacy Policy governs the manner in which we collect, use, maintain and disclose information collected from our users and the rights users have to their personal information. This privacy policy applies to all products and services offered by B&V including,,, as well as any applications, APIs, or any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Sites”).

Personal Identification Information

To perform our services, B&V may collect personal identification information (“Personal Data”) from users in a variety of ways, including, but not limited to, when users visit our Sites, register on our Sites, view a page or transaction, download documents related to a page or transaction, subscribe to a newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Sites. We may collect a user’s IP Address and users may be asked for their name, company, email address, phone number, job title and company mailing address or city and country that the office they work from is located.

Non-personal Identification Information

To ensure the quality and reliability of our services, we may collect non-personal identification information about users whenever they interact with our Sites. Non-personal identification information may include the browser name, the type of computer and technical information about users' means of connection to our Sites, such as the operating system and the Internet Service Providers utilized and other similar information.

Third-Party Processors

B&V may share information, including Personal Data, with its third-party service providers used to provide hosting, backup, storage, communications technology, and other services for B&V. These third-party service providers may have access to or process Personal Data for the purpose of providing these services for B&V; however, we do not permit our third-party service providers to use any Personal Data that we share with them for any other purpose than as necessary to provide services to B&V.

Your Personal Information: Purposes of Collection, Use and Disclosure

By providing Personal Data to us, you consent to us collecting, holding, using and disclosing your Personal Data in accordance with this Privacy Policy. You do not have to provide Personal Data to us, however, if you do not, it may affect your use of our Sites.


Collection of Information from Children:  In addition, we comply with the Children's Online Privacy Protection Act (COPPA), which requires the consent of a parent or guardian for the collection of personally identifiable information from children under 13 years of age.  We do not knowingly collect personally identifiable information relating to children under 13 years of age. In the event that we learn that we have collected personally identifiable information from anyone under 13 years of age without prior parental consent, we will take steps to promptly delete such information.

B&V’s services are utilized by various organizations to facilitate the execution of physical commodity trades, the operational and financial performance of voyage charter contracts, and to calculate delay time and demurrage when a ship is loading or discharging cargo in port. The services may be used to calculate freight and demurrage costs and for the secure transfer or sharing of documents and information to identifiable, qualified and / or authorized recipients of the service. Toward this end, we may process and share Personal Data and usage statistics with our clients (industrial producers, commodity traders, bulk terminals, and shipowners) for certain legitimate business purposes. This includes, but is not limited to, when users visit our Sites, view a trade or voyage, click on external links, securely upload or download documents related to a trade or voyage, and the ability to identify and prevent fraud. We may use third party service providers to help us operate our Sites or administer activities on our behalf. We may share your information with these third parties for those limited purposes as stated in the Section “Third-Party Processors” above.

In addition, we may collect, hold, use and disclose your Personal Data for the following purposes:

  • to enable you to customize or personalize your experience of our Sites
  • to enable you to access and use our Sites, associated applications and associated social media platforms
  • to contact and communicate with you
  • for internal record keeping and administrative purposes
  • to comply with our obligations to provide Personal Data as required by applicable laws and regulations and cybersecurity monitoring and safeguards processes. Specifically, B&V may disclose Personal Data as required by law, regulation or the rules of practice of a governmental or quasi-governmental body. B&V may also disclose Personal Data to law enforcement officials in response to a lawful request made pursuant to national security interests or law enforcement requirements.  and resolve disputes that may  require disclosure of your Personal Data.

If we receive Personal Data about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing Personal Data about somebody else, you represent and warrant that you have such person’s consent to provide the Personal Data to us.

B&V has implemented appropriate policies in place to protect the security and confidentiality of all user Personal Data we receive. B&V limits disclosure of Personal Data to employees, its contractors, its clients, and its Sites users. Sensitive and private data exchange between our Sites and its users happens over an SSL secured communication channel and is end-to-end. No controls or safeguards are one hundred percent effective against data breaches or cyberattacks and there is always risk in providing personal data to any website or internet-based platform or service. If you do not wish to accept this risk, you should not provide any Personal Data to B&V. 

No Error - Free Performance 

B&V does not guarantee error-free performance of the Service or our privacy controls as set out in this Privacy Policy. We may not always catch an unintended privacy issue, despite our efforts to do so. Accordingly, we welcome your feedback regarding any privacy concerns that you may have, including how we can improve this Privacy Policy. We will take prompt corrective action when we learn of any failure to comply with this Privacy Policy.

B&V may retain personal data for a minimum of 6-years to satisfy regulatory compliance, including, but not limited to, the Internal Revenue Service (IRS) and Financial Industry Regulatory Authority (FINRA). 

Though we do not currently anticipate a change in our ownership, in the event of a sale of the company or a significant portion of its assets, B&V may disclose or transfer Personal Data to a purchasing party.

Additional Protection of Your Information

We adopt appropriate data collection, storage and processing practices to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Sites.

Third Party Websites

Users may find content on our Sites that links to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Sites. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to, or from, our Sites, is subject to that website's own terms and policies.

If you are located in the European Economic Area, the United Kingdom or Switzerland, you may have the right to:

  • Request access to and receive information about the Personal Information we maintain about you for our own purposes, to ask us to update and correct inaccuracies in your Personal Information, to restrict or to object to the processing of your Personal Information, to have the information anonymized or deleted, as appropriate subject to exceptions in applicable laws, or to obtain an electronic copy of the Personal Information we have collected pertaining to you and to exercise your right to data portability to easily transfer your Personal Information to another company. In addition, you may also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
  • Withdraw any consent you previously provided to us regarding the processing of your Personal Information, at any time and free of charge. We will apply your preferences going forward, but this will not affect the lawfulness of the processing before your withdrawal of consent.

International Visitors and Customers 

The Service is hosted in the United States. If you are visiting from the European Union (EU) or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and by providing your personal data you consent to:

Data Retention and Deletion: We retain Personal Information we collect only for the time period necessary to complete the business purposes for which the information was collected, or as required by applicable laws or regulations. B&V does not sell Personal Information, but the CCPA defines sale more broadly than the traditional sense of an exchange of data for money and may encompass transactions in which we may disclose your Personal Information. CPRA defines “Share” as the disclosure of Personal Information for use in cross-context behavioral advertising.  Accordingly, you may, subject to exceptions in CCPA and CPRA, request that B&V not “sell” or “share” your Personal Information by submitting this request to us at

The California Consumer Privacy Act of 2018 (“CCPA”), as amended from time to time including by the California Privacy Rights Act (“CPRA”) provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise rights.  


CCPA comprises provisions that explicitly prohibit us from making any adverse decisions about you or your account based upon your exercise of this right (“non-discrimination”).
